Welcome to alyssaditch.com (the “Site”). These Terms and Conditions (“Terms”) govern your use of the Site and your purchase of sessions, memberships, books, retreats, and other services from Alyssa Ditch (“Alyssa,” “we,” “us,” or “our”). By using the Site or booking any service, you agree to these Terms. If you do not agree, please do not use the Site or our services.

ABOUT OUR SERVICES

Alyssa offers intuitive healing sessions (including Reiki, Bach Flower Essence Therapy, and intuitive guidance), Healing Through Dance sessions, Intuitive Talk Zoom Meditations, the Get Intuit monthly membership, the Release and Flow Retreat, and books and media. Sessions are offered remotely (via Zoom) or in person. Descriptions, prices, and availability are shown on the Site and may change at any time.

NOT MEDICAL OR PROFESSIONAL ADVICE

Alyssa’s services are complementary and are provided for spiritual, personal growth, and wellness purposes only. They are not a substitute for professional medical, psychological, psychiatric, legal, or financial advice, diagnosis, or treatment. Alyssa does not diagnose, treat, or cure any condition, and no result is promised or guaranteed.

• Always consult a qualified healthcare provider about medical or mental health concerns.
• Do not stop, change, or delay any medical treatment or medication because of a session.
• If you are in crisis or experiencing a medical emergency, contact local emergency services immediately.
• Any insights, messages, or guidance given in a session are intuitive impressions offered for your consideration, and you remain responsible for your own decisions.

ELIGIBILITY

You must be at least 18 years old to book services or make purchases. Minors may take part only with the permission and involvement of a parent or legal guardian. [CONFIRM age policy]

BOOKING AND SESSIONS

• Sessions are booked through the Site’s booking form. A booking is confirmed only when you receive a confirmation from us.
• All session times are shown in Eastern Time (EST/EDT) unless stated otherwise. Please check your local time.
• For Zoom sessions, you are responsible for a stable internet connection, a working device, and a quiet, private space. Time lost to technical problems on your side may not be extended.
• Please arrive on time. Late arrival may shorten your session. 
• We may reschedule or cancel a session due to illness, emergency, or unforeseen circumstances, and will offer you a new time or a refund of that session.

PRICING AND PAYMENT

• Prices are in US dollars and are shown on the Site. Current prices at the time of writing: Zoom Healing Session 60 min ($125), 45 min ($95), 30 min ($65); Healing Through Dance, 1 hour ($145); Intuitive Talk Zoom Meditations (from $11); Get Intuit Monthly Membership ($122). 
• Payment is due at the time of booking unless we agree otherwise. 
• Payments are processed by a third-party payment provider. We do not store your full card details. 
• You are responsible for any taxes, bank fees, or currency conversion charges that apply to your payment.
• We may correct pricing errors and cancel orders affected by them.

CANCELLATIONS, RESCHEDULING, AND REFUNDS

• Cancellations or rescheduling requests made at least [24] hours before your session are free of charge and eligible for a full refund or a new time.
• Requests made less than [24] hours before your session, and no-shows, may be charged in full.
• Because sessions are personal services, we do not offer refunds after a session has taken place. If you are unhappy with your experience, please contact us and we will do our best to make it right.

MEMBERSHIP (GET INTUIT)

• The Get Intuit membership is a monthly subscription that gives access to continued guidance, meditation, and intuitive practice. 
• Membership fees are billed monthly in advance and renew automatically until cancelled.
• You may cancel at any time by contacting us before your next billing date. Cancellation stops future charges. Payments already made are non-refundable, and you keep access until the end of the paid period. 
• We may change membership benefits or pricing with reasonable notice.

ZOOM MEDITATIONS AND GROUP EVENTS

• Live meditations run on the schedule shown on the Site (currently Tuesdays and Thursdays at 8 a.m. EST) and may be changed or cancelled with notice.
• Join links are for your personal use only and must not be shared.
• Sessions or meditations may be recorded only with notice. Do not record, copy, or distribute any session or meditation without written permission.

RELEASE AND FLOW RETREAT

Retreat registration, pricing, deposits, cancellation, and health and safety terms are set out on the Release and Flow Retreat page or in a separate registration agreement, which forms part of these Terms. Participation in movement or dance activities is voluntary, and you are responsible for taking part within your own physical limits. 

BOOKS AND PRODUCTS

• Books sold through Amazon, Kindle, and Audible are governed by those platforms’ terms, and we are not responsible for their orders, shipping, or returns.
• For signed copies or products purchased directly from the Site, shipping times, costs, and returns are described at checkout or by email. 
• Digital products are delivered electronically, are for personal use only, and are generally non-refundable once delivered.

USER ACCOUNTS

If you create an account, you must give accurate information, keep your login details secure, and are responsible for all activity under your account. Tell us immediately if you suspect unauthorised use. We may suspend or close accounts that breach these Terms.

ACCEPTABLE USE

You agree not to:

• Use the Site for any unlawful, harmful, or fraudulent purpose.
• Harass, abuse, or threaten Alyssa, staff, or other participants.
• Attempt to hack, disrupt, scrape, or overload the Site.
• Upload viruses or malicious code.
• Copy, resell, or redistribute our content or recordings without permission.
• Impersonate any person or misrepresent your identity.

We may refuse service to or remove anyone who breaches these rules.

INTELLECTUAL PROPERTY

All content on the Site, including text, books, meditations, recordings, images, logos, graphics, and design, belongs to Alyssa Ditch or its licensors and is protected by copyright and other laws. You may view and use it for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, or use it commercially without written permission.

TESTIMONIALS

Testimonials on the Site reflect the personal experiences of individuals and are shared with their permission. Results vary, and individual experiences are not a promise or guarantee of similar outcomes.

THIRD-PARTY LINKS AND SERVICES

The Site may link to or rely on third-party services such as Amazon, Audible, Zoom, WhatsApp, payment providers, and social media. We do not control these services and are not responsible for their content, availability, or practices. Your use of them is at your own risk and subject to their terms.

PRIVACY

Our Privacy Policy explains how we collect and use your personal information. By using the Site you agree to that policy.

DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Site and services are provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We do not guarantee any specific outcome from any session, meditation, membership, or product.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Alyssa Ditch will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Site or services. Our total liability for any claim relating to the Site or services will not exceed the amount you paid for the service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

ASSUMPTION OF RISK AND RELEASE

You take part in sessions, movement activities, and retreats voluntarily and at your own risk. You confirm that you are responsible for your own physical, emotional, and mental wellbeing, and that you will tell us of any condition or limitation that may affect your participation. 

INDEMNIFICATION

You agree to indemnify and hold harmless Alyssa Ditch from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site or services.

GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict of law rules. Any dispute will first be discussed in good faith by contacting us. If it cannot be resolved, it will be handled in the state or federal courts located in [COUNTRY], North Carolina, and you consent to that jurisdiction. 

CHANGES TO THESE TERMS

We may update these Terms from time to time. The “Last updated” date shows the latest version. Continued use of the Site or services after changes means you accept the updated Terms.

GENERAL

• If any part of these Terms is found unenforceable, the rest remains in effect.
• Our failure to enforce a right is not a waiver of it.
• These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Site and services.
